1. Introduction and Acceptance

Welcome to LTIC ("Last Time I Cried"). These Terms and Conditions ("Terms") govern your access to and use of the LTIC mobile application ("App") and related services ("Services") provided by LTIC ("we," "us," or "our").

By downloading, installing, or using our App, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, please do not use our Services.

We recommend that you print or save a copy of these Terms for your records.

2. About Our Services

LTIC is an emotional support and event tracking social platform that allows users to:

  • Record and track emotional events
  • Share experiences with the community
  • Connect with and support other users
  • Receive and send supportive reactions and comments

Important: LTIC is not a substitute for professional mental health services. If you are experiencing a mental health crisis, please contact emergency services or a mental health professional immediately.

3. Eligibility and User Accounts

To use LTIC, you must:

  • Be at least 16 years old (or 13 years old with parental consent where permitted by local law)
  • For users in the European Union: be at least 16 years old, or have verifiable parental consent if between 13-16 years old
  • Register for an account using accurate and complete information
  • Maintain the confidentiality and security of your account credentials
  • Notify us immediately of any unauthorized access to your account
  • Accept full responsibility for all activities that occur under your account

We reserve the right to refuse service, terminate accounts, or remove content at our sole discretion.

4. User Content and License

4.1 Ownership: You retain all ownership rights to the content you create and post on LTIC ("User Content"). We do not claim ownership of your User Content.

4.2 License Grant: By posting User Content, you grant us a non-exclusive, worldwide, royalty-free, sublicensable, and transferable license to use, reproduce, modify, distribute, and display your User Content solely for the purpose of operating and providing the Services. This license terminates when you delete your User Content or account, except where your content has been shared with others and they have not deleted it.

4.3 Prohibited Content: You agree not to post content that:

  • Is illegal or promotes illegal activities
  • Is harassing, abusive, threatening, or promotes violence
  • Contains hate speech or discrimination
  • Infringes on intellectual property rights of others
  • Contains spam, advertising, or commercial solicitation
  • Contains malware or malicious code
  • Impersonates another person or entity
  • Violates the privacy of others
  • Is sexually explicit or contains nudity
  • Promotes self-harm or suicide

5. Community Guidelines

To maintain a supportive environment, all users must:

  • Be respectful, kind, and supportive of other community members
  • Maintain confidentiality of experiences shared by others
  • Report harmful, inappropriate, or concerning content promptly
  • Not share personal identifying information of others without consent
  • Not engage in bullying, harassment, or intimidation
  • Respect the boundaries and privacy settings of other users

6. Intellectual Property

6.1 Our Rights: The App, including its design, features, functionality, and all content provided by us (excluding User Content), is owned by us and protected by copyright, trademark, and other intellectual property laws.

6.2 Limited License: We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes in accordance with these Terms.

7. Third-Party Services

Our Services may contain links to or integrate with third-party services, including:

  • Apple Sign-In for authentication
  • Push notification services
  • Analytics services

We are not responsible for the content, privacy policies, or practices of third-party services. Your use of such services is subject to their respective terms and policies.

8. Account Suspension and Termination

8.1 By Us: We may suspend or terminate your account and access to the Services if you:

  • Violate these Terms or our Community Guidelines
  • Engage in fraudulent or illegal activity
  • Create risk or possible legal exposure for us
  • Have an account that has been inactive for an extended period

8.2 By You: You may terminate your account at any time by using the account deletion feature in the App or by contacting us at support@ltic.app.

8.3 Effect of Termination: Upon termination, your right to use the Services will cease immediately. We will delete your account data in accordance with our Privacy Policy.

9. Disclaimers

9.1 No Warranty: THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

9.2 Not Medical Advice: LTIC does not provide medical, psychological, or professional health advice. Content shared by users is for informational and peer support purposes only.

9.3 Availability: We do not guarantee that the Services will be uninterrupted, secure, or error-free.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID US, IF ANY, IN THE PAST TWELVE (12) MONTHS.

11. Indemnification

You agree to indemnify and hold harmless LTIC, its affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from or related to your use of the Services, your User Content, or your violation of these Terms.

12. Governing Law and Dispute Resolution

12.1 Governing Law: These Terms shall be governed by and construed in accordance with the laws of the United States and the State of California, without regard to conflict of law principles.

12.2 EU Users: If you are a consumer in the European Union, you will benefit from any mandatory provisions of the law of your country of residence. Nothing in these Terms affects your rights as a consumer to rely on such mandatory provisions of local law.

12.3 Dispute Resolution: Any disputes arising from these Terms or your use of the Services shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

13. Changes to Terms

We may modify these Terms at any time. When we make material changes, we will:

  • Update the "Last updated" date at the top of these Terms
  • Notify you through the App or via email
  • Give you at least 30 days' notice before changes take effect for material changes

Your continued use of the Services after the effective date of the revised Terms constitutes your acceptance of the changes. If you do not agree to the new Terms, you must stop using the Services.

14. General Provisions

14.1 Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding your use of the Services.

14.2 Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

14.3 Waiver: Our failure to enforce any right or provision of these Terms will not be considered a waiver of such right or provision.

14.4 Assignment: You may not assign or transfer these Terms without our prior written consent. We may assign our rights and obligations under these Terms without restriction.
